When probate matters become contentious, Reid and Riege litigators work closely with our estate planning and estate settlement attorneys to seek negotiated resolutions, or to bring or defend claims in the Probate and Superior courts. These litigation and estate attorneys, often working in teams as appropriate, represent professional fiduciaries, charities and heirs and beneficiaries of estates and trusts, and also individuals who have had fiduciary duties thrust upon them as executors or trustees, often of the estates and trusts of deceased loved ones. These matters include:
- Will and trust contests;
- Will and trust construction matters (i.e., disputes about the interpretation of will and trust language);
- Claims of breach of fiduciary duty;
- Efforts to remove executors, administrators, and trustees; and
- Petitions for trust modification or termination.
